Cherie Naturals — Terms and Conditions

Last Updated: 31.10.2026

1. Acceptance of Terms

These Terms and Conditions (“Terms”) govern your access to and use of the Cherie Naturals website, online store, checkout pages, related services, and any products or subscription services offered through them (collectively, the “Website” and “Products”).

In these Terms, “Cherie Naturals,” “we,” “us,” and “our” refer to the operator of the Website. The legal name of the business operating the Website should be inserted before publication.

By accessing the Website, creating an account, placing an order, enrolling in a subscription, or otherwise using our services, you confirm that you are at least 18 years old (or the age of legal majority where you live), have the legal capacity to enter into these Terms, and agree to be bound by them. If you do not agree, do not use the Website.

1.1 Electronic Consent

Where required, we may ask you to affirmatively accept these Terms by checking a box, selecting a button, or taking another clearly identified action. Your electronic acceptance may have the same legal effect as a written signature to the extent permitted by law.

1.2 Changes to These Terms

We may update these Terms from time to time. We will post the updated version on the Website and revise the “Last Updated” date. If a change requires notice under applicable law, we will provide that notice by an appropriate method. Changes will take effect as stated in the notice or updated Terms. Your continued use of the Website after an effective change indicates acceptance to the extent permitted by law.

2. Website Access and Availability

We grant you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable right to access and use the Website for personal, lawful, non-commercial purposes.

We may change, suspend, restrict, or discontinue any part of the Website, or restrict access where reasonably necessary to protect the Website, our customers, or our business. We will not exclude liability where doing so is prohibited by law. We do not guarantee that the Website will always be available or operate without interruption.

3. Account Security

If you create an account, you agree to provide accurate, current, and complete information and to keep it updated. You are responsible for protecting your login credentials and for activity carried out through your account, except where applicable law provides otherwise.

Please notify us promptly at help@cherienaturals.com if you suspect unauthorized access to your account. We may suspend or disable an account where reasonably necessary, including if we believe these Terms have been violated or account security is at risk.

4. Prohibited Uses

You agree not to:

  • Use the Website in violation of any applicable law or regulation.
  • Access or collect Website information through scraping, crawling, or automated methods without our written permission.
  • Interfere with the Website’s security, functionality, or operation.
  • Upload or transmit malicious code or harmful material.
  • Engage in fraud, deception, or other unlawful conduct.
  • Impersonate another person or misrepresent your identity or affiliation.
  • Attempt to gain unauthorized access to any account, system, or data.
  • Copy, misuse, or exploit Website content except as permitted by law or with our written consent.

We may investigate suspected misuse and take appropriate action consistent with applicable law.

5. Intellectual Property

Unless otherwise stated, the Website and its content—including text, product descriptions, photographs, graphics, logos, branding, design elements, and software—are owned by or licensed to the business operating Cherie Naturals and are protected by applicable intellectual-property laws.

You may view and use Website content for your personal, non-commercial use. You may not reproduce, distribute, modify, publish, sell, or commercially exploit Website content without prior written permission, except where applicable law permits it. No intellectual-property rights are granted except as expressly stated in these Terms.

6. Product Information and Supplement Disclaimer

Information on the Website about dietary supplements has not been evaluated by the United States Food and Drug Administration unless a specific statement clearly says otherwise. Our supplements are not intended to diagnose, treat, cure, or prevent any disease.

Product descriptions, articles, testimonials, educational materials, and other Website content are provided for general informational purposes and are not medical advice. Consult a qualified healthcare professional before using a dietary supplement, especially if you are pregnant or nursing, take medication, have a medical condition, or have questions about whether a product is appropriate for you. Follow the product label and directions for use.

Individual experiences and results may vary. Testimonials represent the experiences of the individuals providing them and should not be understood as a guarantee of typical results.

6.1 No Professional Advice

Nothing on the Website is a substitute for medical advice, diagnosis, or treatment from a qualified healthcare professional. Do not disregard professional medical advice or delay seeking it because of information you have read on the Website.

6.2 Use of Website Information

You are responsible for evaluating information on the Website and deciding whether it is appropriate for your circumstances. To the extent permitted by law, we are not responsible for decisions made solely in reliance on general Website content. Third-party content reflects its authors’ views and does not necessarily represent our views.

7. Electronic Communications

When you use the Website, place an order, create an account, or contact us, you agree that we may communicate with you electronically about your transactions and account, including order confirmations, shipping updates, subscription notices, and customer-support matters.

We may also send marketing communications where you have provided any consent required by law. You can unsubscribe from marketing emails using the unsubscribe link in the message. Opting out of marketing communications will not prevent us from sending essential transactional or service-related messages.

To the extent permitted by law, electronic communications satisfy legal requirements that communications be in writing.

8. Privacy and Tracking Technologies

8.1 Privacy Policy

Our collection and use of personal information are described in our Privacy Policy. Please review that policy for details about the information we collect, how we use it, and the choices available to you.

8.2 Cookies, Pixels, and Similar Technologies

The Website may use cookies, pixels, and similar technologies to operate the store, remember preferences, understand Website performance, and support analytics or advertising. Where required, we will request consent or provide controls for these technologies. Information may be shared with service providers and advertising or analytics partners as described in our Privacy Policy and permitted by law.

9. Orders, Payments, and Billing

9.1 Orders and Acceptance

Submitting an order is an offer to purchase the selected Products. An order is not accepted until we confirm acceptance or otherwise indicate that the order has been accepted. We may refuse or cancel an order for legitimate reasons, including suspected fraud, product unavailability, or a material pricing or listing error. If payment has already been collected for an order we cancel, we will arrange any refund required by law.

Prices and charges will be displayed at checkout. Unless otherwise stated, prices are shown in U.S. dollars. Prices, promotions, and product availability may change, but changes will not alter an accepted order except as permitted by law or agreed with you.

9.2 Payment Authorization

When you submit payment information, you confirm that you are authorized to use the selected payment method and that the information is accurate. You authorize us and our payment providers to charge the amount shown at checkout, including the price of Products, disclosed shipping charges, applicable taxes, and any other disclosed fees. If a payment is declined or cannot be verified, we may delay, suspend, or cancel the order.

9.3 Third-Party Payment Providers

Payments may be processed by third-party payment providers. Their services may be subject to separate terms and privacy policies. We are not responsible for a third-party provider’s independent systems or policies, but this does not limit any responsibility that cannot legally be excluded.

10. Shipping, Delivery, and Risk of Loss

Products are shipped using carriers and fulfillment providers. Estimated delivery dates are estimates, not guarantees, unless we expressly state otherwise or applicable law requires otherwise.

Delivery may be affected by carrier operations, weather, customs, supply disruptions, or inaccurate delivery information. You are responsible for providing a complete and accurate shipping address. International customers may be responsible for applicable customs duties, import taxes, or other charges disclosed for their order.

Ownership, delivery, and risk-of-loss rules will be determined under applicable law and any mandatory consumer protections. A carrier’s tracking status may be considered when reviewing a delivery inquiry, but it will not automatically override rights available under applicable law.

11. Product Availability, Errors, and Inaccuracies

We make reasonable efforts to display accurate product descriptions, prices, images, and availability. However, errors or omissions may occur, and product packaging or appearance may vary from images shown.

We may correct errors, update information, or change availability. If a material error affects an order already placed, we may contact you to discuss the available options or cancel the affected order and provide any refund required by law.

12. Events Beyond Our Control

We will not be responsible for delay or failure to perform an obligation to the extent it is caused by an event beyond our reasonable control, such as a natural disaster, public-health emergency, labor dispute, supply-chain disruption, government action, war, internet or payment-system outage, or carrier delay. This section does not remove rights or remedies that cannot be excluded under applicable law.

13. Subscriptions and Automatic Renewal

This section applies only if subscription or recurring-purchase options are offered and selected.

13.1 Subscription Enrollment

If you enroll in a subscription, you authorize recurring orders and charges at the frequency and price disclosed during checkout, until you cancel in accordance with the cancellation instructions provided. Each subscription’s applicable price, billing interval, shipment frequency, and cancellation terms should be clearly disclosed before purchase.

13.2 Disclosure and Consent

Before you complete a subscription purchase, we will present the recurring nature of the charges, billing frequency, amount or method for determining the amount, and cancellation terms in a clear manner as required by applicable law. We will obtain any required affirmative consent.

13.3 Automatic Renewal

Unless you cancel as described below, your subscription may renew automatically at the then-current price and selected billing interval. We will provide renewal notices or advance notice of price changes when required by law or as otherwise stated at checkout.

13.4 How to Cancel

You may cancel a subscription using the cancellation method shown in your account, the subscription-management portal provided at checkout, or by contacting help@cherienaturals.com. We will not require you to speak to a live representative if applicable law prohibits that requirement.

To avoid the next scheduled charge, submit your cancellation sufficiently before the next billing date. Online cancellations should take effect in accordance with the confirmation shown by the cancellation system. Email requests may require processing time; we will confirm cancellation.

After cancellation takes effect, no further recurring charges or shipments should be made for subsequent cycles, though an order already processed may still be fulfilled subject to applicable law and the disclosed terms.

13.5 Updated Payment Details

Payment processors or card networks may provide updated payment credentials for a stored payment method. Where permitted and applicable, those updates may be used to process an authorized subscription payment. You can manage your stored payment method or cancel your subscription using the available account controls.

13.6 Failed Payments

If a recurring payment fails, we may retry the charge, contact you for updated payment information, or pause shipments until payment is completed, subject to applicable law and the subscription terms disclosed at checkout. Any collection activity will be conducted only as permitted by law.

14. SMS and Mobile Messaging

This section applies only if Cherie Naturals operates an SMS or mobile messaging program.

14.1 Consent to Messages

If you opt in, you may receive recurring transactional or marketing text messages at the number you provide. Message frequency may vary, and message and data rates may apply. Consent to marketing texts is not a condition of purchasing Products where prohibited by law.

14.2 Carriers and Delivery

Wireless carriers are not responsible for delayed or undelivered messages. Message delivery depends on your carrier and other systems outside our control.

14.3 Age Requirements

Do not opt into the messaging program unless you meet the minimum age requirements applicable to the program and your location. If parental consent is legally required, it must be obtained before participation.

14.4 Program Details and Frequency

Messages may include order updates, shipping notifications, customer-support replies, promotions, product announcements, or reminders, depending on your consent and interactions with us. Message frequency varies.

14.5 Mobile Information

We will handle mobile information in accordance with our Privacy Policy and applicable law. If the program uses a specific mobile-information sharing restriction, make sure the published statement accurately reflects actual practices before including it.

Important: The original source contains Florida-specific telemarketing language. It has not been carried over here because its applicability and enforceability depend on the actual program and legal review. Have counsel review any state-specific SMS terms before publishing.

15. Reviews and Other User Content

If the Website allows you to submit reviews, comments, photographs, testimonials, or other content (“User Content”), you are responsible for the content you submit.

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and adapt that content in connection with operating, promoting, and improving our business, subject to applicable law and our Privacy Policy. This license should be adjusted if you do not intend to use customer content for marketing.

You confirm that you have the rights necessary to submit the content, that it does not unlawfully infringe another person’s rights, and that it is not knowingly false, deceptive, or unlawful. You must disclose any material connection or incentive associated with a review where required by law.

We may moderate, decline, or remove User Content where reasonably necessary, but we are not obligated to monitor all submissions. We may disclose information where required by law or valid legal process.

16. Website and Product Disclaimers

To the extent permitted by applicable law, the Website and its content are provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation, or that all defects will be corrected.

Nothing in these Terms excludes a warranty, guarantee, or consumer right that cannot lawfully be excluded or limited. Any disclaimer applies only to the fullest extent permitted by applicable law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, Cherie Naturals and the business operating the Website will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business interruption, arising from use of the Website, Products, subscriptions, or these Terms.

To the extent permitted by law, our total liability for a claim will be limited to the amount you paid us for the Product or service giving rise to the claim during the 12 months before the event, or US $100, whichever is greater.

These limits do not apply to liability that cannot legally be limited or excluded, including where applicable law prohibits such a limitation.

18. Indemnification

To the extent permitted by law, you agree to be responsible for losses and reasonable costs arising from your unlawful use of the Website, your material breach of these Terms, or your infringement of another person’s rights. Nothing in this section requires you to indemnify us for our own conduct where such a requirement is prohibited by law.

We may control the defense of a claim for which indemnification is available, and you agree to provide reasonable cooperation. Any settlement that imposes obligations on you requires your consent where required by law.

19. Time Limits for Claims

Any contractual time limit for bringing a claim must comply with applicable law.Nothing in these Terms shortens a limitation period where doing so is prohibited by law.

20. Dispute Resolution

The source Terms contained a binding arbitration agreement, a pre-dispute notice process, an arbitration provider, a small-claims exception, and court-relief provisions. Those provisions have not been reproduced as a complete arbitration clause here because the appropriate terms depend on the legal business entity, customer locations, sales practices, and applicable law.

Before publishing this section, decide—after legal review—whether disputes will be handled in court, through arbitration, or under another lawful process. If arbitration is used, clearly explain its scope, provider and rules, costs, opt-out procedure if applicable, location, available remedies, and any exceptions. Do not state that arbitration is mandatory unless the business has adopted a reviewed and legally appropriate agreement.

21. Class and Representative Proceedings

Any class-action waiver or restriction on representative proceedings must be reviewed by qualified counsel and may not be enforceable in every jurisdiction. Do not publish a waiver unless it has been tailored to the business and complies with applicable law. Nothing in these Terms limits rights that cannot legally be waived.

22. Mass Arbitration Procedures

Any special process for handling multiple similar arbitration claims must be drafted and reviewed by qualified counsel. The source Terms contained a batching procedure and special-master mechanism; those detailed procedures are not adopted by this rewritten draft. Do not add them without confirming that they are appropriate, transparent, and enforceable.

23. Jury Trial

Any waiver of a jury trial must be reviewed by qualified counsel and may not be enforceable in every jurisdiction. Nothing in these Terms waives a right that cannot legally be waived.

24. Arbitration Opt-Out

If the business adopts an arbitration agreement that includes an opt-out right, the final terms must clearly state the opt-out deadline, method, address or email, required information, and when the period begins. The original source specified a 30-day period and certified-mail notice, but those details are not adopted here. Insert an accurate, legally reviewed process before publishing an arbitration agreement.

25. Severability

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted by law or severed to the extent necessary. The remaining provisions will continue to apply, subject to applicable law.

26. Governing Law and Venue

The governing law and venue must be selected based on the actual legal entity operating Cherie Naturals and the laws applicable to the business and its customers. The original source named Wyoming law and courts, but that choice has not been adopted in this draft. Nothing in this section removes mandatory consumer protections that apply where you live.

27. General Terms

These Terms, together with any policies expressly incorporated into them, form the agreement governing your use of the Website, subject to any additional terms shown at checkout or for a particular service.

A failure to enforce a provision is not a continuing waiver of that provision. You may not transfer your rights or obligations under these Terms without our consent, except where applicable law permits otherwise. We may transfer our rights and obligations as part of a business reorganization or sale, subject to applicable law.

Provisions that by their nature should continue after termination will survive to the extent necessary and lawful. These Terms will not be interpreted to remove any rights that cannot be waived under applicable law.
